The decision was to order the de-listing of the Churchill Arms as an asset of community value. This was on the basis that East Dorset District Council made an error in law allowing the Churchill Arms to be listed on the basis of an erroneous “community nomination” having considered the facts and rationale of Judge Simon Bird QC in Trustees of J Marshall Limited SSAS v Arun District Council [2016] CR/2016/0025.
