The Dorset Library Service is a service provided by Dorset Council, and Dorset Council is the legal body responsible under this contract.

In these terms, ‘you’ refers to the individual borrowing the iPad and ‘Dorset Library Service’, ‘us’ or ‘we’ refer to Dorset Council, in particular the library service.

Borrowing and returning the iPad

  1. To borrow an iPad you will need to visit one of the libraries participating in the scheme and become a full library member
  2. The period of loan for the iPad is up to six weeks from the date of issue.
  3. The iPads can be locked remotely (preventing access) by Dorset Library Service and may be locked if:
  • we suspect you have not complied with these terms
  • after six weeks (the date it should be returned) or
  • if you report that the iPad has been lost or stolen
  1. Before returning the iPad you must complete the feedback form available on the iPad. Dorset Library Service use this form to gather information to help us develop and improve the service.
  2. The iPad must be returned:
  • in good working order and in the same condition as borrowed
  • during library opening hours
  • by the return date to the library from which it was borrowed, and
  • directly to a member of library staff and must not be left in any out of hours return location.
  1. All data and information will be deleted from the device by a member of staff upon it being returned to the library.

How the iPad can be used

  1. The iPads are to be used for the purposes of research and information in relation to job searching, up-skilling or for information and support in relation to health, wellbeing and general Internet browsing.
  2. You must comply with the Dorset Library Service Acceptable Use Policy Computer use policy - Dorset Council
  3. You must not download / run / play program files which are not supported by Dorset Library Service. To prevent viruses and malicious software some file types are blocked and cannot be downloaded.
  4. You must not look at illegal information / websites.
  5. You must not use the device to view, read, download, upload, distribute, circulate or sell any material which is pornographic, obscene, racist, sexist, offensive or intended to cause harassment, alarm, distress, to stir up or cause racial hatred. It is illegal to discriminate against others or to harass others by publishing or circulating discriminatory information.
  6. You must have the consent of individuals featured before publishing information online, including photographs and video files. It is unlawful to publish untrue information which damages the reputation of a person or organisation, or holds them up to hatred, ridicule or contempt.
  7. You must not break copyright law. All information on the Internet is subject to copyright unless specifically stated otherwise, including images, text, video, audio and all file types. Illegal download websites which break copyright are blocked by the web filter.
  8. You must not use our devices for any illegal activity including computer hacking, maliciously changing software, writing and publishing computer viruses.

What happens if you break the terms and conditions or misuse the device

  1. If a device (iPad, headphones, keyboard/cover, charger or case) is returned damaged, the borrower will be charged for the repair or replacement. Borrowers must not use a third party to repair a damaged device. Charges shall be set at Dorset Library Service’s reasonable discretion. Non-payment of charges may result in suspension of the borrower’s library membership.
  2. Depending on the circumstances and the type of misuse, library staff may:
  • ask you to stop your inappropriate behaviour
  • lock the iPad remotely to prevent further use
  • contact you to immediately return the iPad even if this is part way through the loan period
  • write to issue a warning that services may be withdrawn if you continue to misuse the service
  • write to inform you that services have been withdrawn due to misuse, or
  • inform the police and instigate an investigation.

Legislation

  1. Dorset library Service has no control over the information provided on the internet. It cannot be held responsible for the content or accuracy of any information that customers obtain. We allow customers to download and print material but is up to the customers to make sure that they follow the Copyright Design and Patent Act (1988) when they create, download or print material.
  2. The device must be used in accordance with all laws in force at the time of the borrowing.

Your personal data

  1. Please exercise reasonable caution when disclosing your personal data, for example on websites or using email. Dorset Library Service are not responsible for the treatment of data you provide to third parties while using the iPad.
  2. Dorset Library Service will not put any of your personal details on the iPad.
  3. Dorset Library Service will hold your membership details in accordance with our data protection policy (Dorset Library Service privacy notice - Dorset Council) and the following:

  6. Purpose for Processing – Information is collected to enable the supply and return of a loan device and to manage any infringements in relations to the conditions of use. Data may also be used to monitor quality of service, for audit and for dealing with any enquiries or complaints.
  7. Lawful Basis for Processing – Article 6(1)(b) of the GDPR – processing is necessary for the performance of a contract.
  8. Data Sharing – The personal data provided shall not be shared with third parties.
  9. Transfers Abroad – This data will not be transferred abroad.
  10. Data Retention – This data will be retained for a period of 12 months.
  11. Your Rights – You have the right to ask Dorset Council to a copy of your data, the right to rectify or erase your personal data, and the right to object to processing. However, these rights are only applicable if the council has no other legal obligation concerning that data. You also have the right to complain to the regulator, Make a complaint to the ICO
