Non-domestic rates credit list
Information about credit balances is exempt under section 31(1)(a) of the Freedom of Information Act 2000.
We no longer publish information about business rates accounts that have credit balances in response to Freedom of Information (FOI) requests. This is because disclosing it could result in fraudulent refund claims.
This follows a decision of the Information Commissioner's Office (ICO) on 6 February 2017. The decision was about an FOI request for national non-domestic rates (NNDR) credit balances.
When we engage section 31 of the Freedom of Information Act, we must consider public interest.
We have considered that it is in the public interest that we:
- make sure our business is transparent and efficient
- prevent fraudulent refund claims, costing public money
We feel that preventing fraud outweighs disclosing information about credit balances.
